Xclusive Radio is a UK-based internet radio station operated by Mack's Sports & Entertainment Limited. Our Services include, but are not limited to:

• Live Streaming: 24/7 streaming across 18+ specialist music channels.
• Channel Subscriptions: Paid monthly or annual access to premium channels via Stripe or PayPal.
• Online Shop: Sale of branded merchandise, clothing, accessories, and music products, including pre-order deposits.
• Events: Promotion and ticketing for live music events.
• Competitions: Prize draws and competitions for eligible subscribers.
• Podcasts: Music, business, legal, and health podcast content.
• Downloads: Digital music content available for download.
• AI Assistant (Xara): An AI-powered customer service assistant.
• News & Blog: Editorial content relating to music, culture, and the station.

You must be at least 18 years of age to purchase products, subscribe to paid channels, or enter competitions. By using our Services, you confirm that you meet this requirement.

Where account registration is required, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect any unauthorised use.

Certain channels require a paid subscription. By subscribing, you agree to the following:

• Subscription fees are charged in advance on a monthly or annual basis.
• Monthly tokens expire after 31 days; annual tokens expire after 366 days from the date of purchase.
• Subscriptions automatically renew unless cancelled before the renewal date.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
• We reserve the right to change subscription pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new price.
• Access to subscription content is for personal, non-commercial use only. Sharing access credentials is strictly prohibited.

The Main Channel subscription (£2.99/month) includes automatic entry into eligible prize draws, subject to the competition rules set out in Section 8.

4.1 General Shop Terms

All products listed in our shop are subject to availability. We reserve the right to withdraw any product at any time. Prices are displayed in pounds sterling (GBP) and are inclusive of VAT where applicable.

By placing an order, you make an offer to purchase the product(s) at the stated price. A contract is formed when we confirm your order by email. We reserve the right to decline any order at our discretion.

4.2 Pre-Order Deposits

Some products are available for pre-order. A deposit of 25% of the product price is required to secure a pre-order. The following terms apply:

• The deposit is non-refundable unless the product becomes unavailable or we are unable to fulfil your order.
• The remaining balance will be due prior to dispatch. We will contact you with payment instructions when your order is ready.
• Estimated delivery dates are indicative only and may be subject to change. We will notify you of any significant delays.

4.3 Delivery

Delivery timescales and charges are displayed at checkout. We aim to dispatch orders promptly; however, we cannot guarantee delivery dates. Risk of loss passes to you upon delivery. We are not responsible for delays caused by third-party couriers or circumstances beyond our control.

4.4 Returns and Refunds

Under the Consumer Contracts Regulations 2013, you have the right to cancel most orders within 14 days of receiving your goods without giving a reason. To exercise this right, contact us at [email protected]. Returned items must be in their original, unused condition. Return postage costs are your responsibility unless the item is faulty or incorrectly supplied.

Refunds will be processed within 14 days of receiving the returned goods. Digital downloads and personalised items are exempt from the right of cancellation once downloaded or produced.

Event tickets purchased through our website are subject to the following:

• Tickets are non-refundable except where an event is cancelled or significantly changed by us.
• In the event of cancellation, we will offer a full refund or, where possible, the option to transfer your ticket to a rescheduled date.
• Tickets may not be resold or transferred without our prior written consent.
• We reserve the right to refuse entry to any event at our discretion.
• Event details, including dates, venues, and line-ups, are subject to change. We will endeavour to notify ticket holders of any significant changes.

Podcast content and downloadable music files are provided for personal, non-commercial use only. You may not reproduce, redistribute, broadcast, or sell any content obtained through our Services without our express written permission.

All content is protected by copyright and other intellectual property rights owned by or licensed to Mack's Sports & Entertainment Limited. Unauthorised use may give rise to a claim for damages and/or be a criminal offence.

Our AI assistant, Xara, is provided as a customer service tool to help you navigate our Services. Please note the following:

• Xara is an automated system and does not constitute professional advice of any kind.
• Responses generated by Xara are based on information available to us at the time and may not always be complete or up to date.
• We do not accept liability for any decisions made in reliance on information provided by Xara.
• Conversations with Xara may be reviewed by our team for quality assurance and service improvement purposes.
• You must not use Xara to submit abusive, offensive, or unlawful content. We reserve the right to restrict access to Xara for users who misuse the service.

Competitions and prize draws are open to eligible UK residents aged 18 and over, unless otherwise stated. The following general rules apply:

• Entry into prize draws is automatic for active Main Channel subscribers, subject to the competition being open and authorised.
• No purchase is necessary to enter where an alternative free entry route is provided.
• Winners will be selected at random from all valid entries and notified by email.
• Prizes are non-transferable and cannot be exchanged for cash.
• We reserve the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.
• Our decision on all competition matters is final.
• Competitions are subject to any additional rules published on the relevant competition page.
• Competitions are subject to applicable UK law and any required regulatory authorisation.

Payments are processed securely via our third-party payment providers (Stripe and PayPal). By making a payment, you agree to their respective terms and conditions. We do not store your full card details on our servers.

All transactions are in pounds sterling (GBP). We are not responsible for any currency conversion charges applied by your bank or card provider.

All content on this website, including but not limited to text, graphics, logos, images, audio clips, and software, is the property of Mack's Sports & Entertainment Limited or its content suppliers and is protected by UK and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes. This licence does not include the right to reproduce, modify, distribute, or create derivative works from any content without our prior written consent.

We do not warrant that our Services will be uninterrupted, error-free, or free from viruses or other harmful components. We make no warranty regarding the accuracy, completeness, or reliability of any content available through our Services.

To the fullest extent permitted by applicable law, Mack's Sports & Entertainment Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of our Services.

Our total liability to you for any claim arising out of or in connection with these Terms or our Services shall not exceed the amount paid by you to us in the 12 months preceding the claim.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
